Terms of Service

1. Scope and provider

These terms govern the use of the "shinealyse" service, offered by Tobias Herb, Prozessionsweg 17, 69226 Nußloch ("we"). Contact: info@shinealyse.com.

2. Subject matter

We offer an AI-based colour, make-up and style analysis based on a photo you upload. There is a free first analysis (one analysis card) and a paid full report (all analysis cards, as a digital file/PDF). The analysis is produced automatically.

3. Conclusion of contract

For the free analysis, the contract is concluded when you confirm the link sent to you by email (a single confirmation via the verification link). For the paid report, the contract is concluded once payment is completed via our payment provider Stripe; the report is then created after you upload your photo.

4. Prices and payment

The price of the paid report is shown before the contract is concluded (currently €14.99 in the eurozone; other regions may differ). Under the German small-business rule (§ 19 UStG) no VAT is shown. Payment is processed via Stripe.

5. Supply of digital content

The report is provided immediately after processing (by email as a PDF). A suitable photo is required; you warrant that you are entitled to use the photo and — where identifiable persons are depicted — that the person shown is you or that consent has been obtained.

6. Right of withdrawal for consumers

Consumers have a statutory right of withdrawal. A consumer is any natural person who enters into a transaction for purposes predominantly outside their trade, business or profession.

Withdrawal instruction

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded. To exercise the right of withdrawal, you must inform us (Tobias Herb, Prozessionsweg 17, 69226 Nußloch, info@shinealyse.com) of your decision by a clear statement (e.g. by email). To meet the deadline, it is sufficient that you send your communication before the withdrawal period expires.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than fourteen days from the day on which we receive your notice of withdrawal.

Early expiry of the right of withdrawal

For a contract for the supply of digital content not on a tangible medium, the right of withdrawal lapses if you have expressly agreed that we begin performance before the end of the withdrawal period and you have confirmed your awareness that, by giving your consent, you lose your right of withdrawal once performance begins (§ 356(5) German Civil Code). We obtain this consent separately before purchase.

7. Nature of the analysis; no professional advice

The analysis is produced with AI support and serves informational and creative purposes. It does not constitute medical, psychological or other professional advice. We do not warrant that the analysis is accurate, complete or fit for any particular purpose in every case.

8. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For simple negligence we are liable only for breach of a material contractual obligation and limited to the foreseeable damage typical for the contract. Otherwise liability is excluded. Mandatory statutory provisions (in particular under product liability law) remain unaffected.

9. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer-protection provisions of your country of habitual residence remain unaffected. The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
